DMCA

The Digital Millennium Copyright Act (“DMCA”) serves as a legal framework to protect the rights of copyright owners and regulate online copyright infringement. This DMCA policy outlines our procedures for addressing copyright infringement claims on “theinstanderapk.net” (referred to as the “Website” or “Service”).

Copyright Infringement Claims

If you believe that your copyrighted work has been infringed upon on our Website, you (the “Complainant”) or your authorized agent may submit a formal copyright infringement notification (“Notification”). The Notification must include:

  • Identification of the copyrighted work(s) claimed to have been infringed.
  • Identification of the infringing material and its location on the Website.
  • Sufficient information to allow us to contact the Complainant, such as name, address, phone number, and email address.
  • A statement by the Complainant that they have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement by the Complainant, made under penalty of perjury, that the information provided in the Notification is accurate and that they are the copyright owner or authorized to act on behalf of the copyright owner.

Review Process

Upon receipt of a valid Notification, we will promptly investigate the alleged infringement. If we determine that the material in question is infringing upon copyright, we will take appropriate action, which may include removing or disabling access to the infringing material.

Counter-Notification

If a user believes that their content was removed or disabled as a result of a mistake or misidentification, they may submit a counter-notification. The counter-notification must include:

  • Identification of the material that was removed or disabled.
  • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • The user’s name, address, phone number, and email address.
  • A statement consenting to the jurisdiction of the federal district court for the judicial district in which the user’s address is located or, if the user’s address is outside of the United States, to any judicial district in which the Website may be found, and that the user will accept service of process from the Complainant or their agent.

Reservation of Rights

We reserve the right to refuse to process Notifications or counter-notifications that do not comply with the DMCA requirements. Additionally, we may terminate the accounts of users who are deemed to be repeat infringers.

Changes to Policy

We may revise this DMCA policy at any time without prior notice. It is the responsibility of users to review this policy periodically for any changes.
